This End User License Agreement ("EULA") is a legal agreement between you and Lost Pines Creative LLC for the NomadCore mobile application.
1. Agreement to Terms
By downloading, installing, or using NomadCore, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not download, install, or use the app.
2. License Grant
Lost Pines Creative LLC grants you a non-exclusive, non-transferable, revocable license to use NomadCore for personal, non-commercial use on devices you own or control, subject to the terms of this EULA and the applicable terms of the Apple App Store or Google Play Store.
3. Restrictions
You agree not to:
- Copy, modify, reverse engineer, decompile, or disassemble the app or any portion thereof
- Distribute, sublicense, rent, lease, or lend the app to any third party
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
- Use the app for any unlawful purpose or in violation of any applicable laws or regulations
4. Intellectual Property
All content, design, code, and intellectual property within NomadCore is the property of Lost Pines Creative LLC and is protected by United States and international copyright laws. Military field manuals and other public domain content included in the app remain in the public domain. User-generated content (emergency plans, inventory lists, contacts) remains your property.
5. Third-Party Services
NomadCore may connect to third-party services, including Open-Meteo and NOAA/NWS (weather and alerts), OpenStreetMap, Google Maps, and Nominatim (maps and geocoding), Supabase (optional account, cloud backup, and family sharing), and Sentry (crash reporting). These services are governed by their own terms and privacy policies. Lost Pines Creative LLC is not responsible for the availability, accuracy, or changes to third-party services. 6. Offline Functionality
NomadCore is designed to work offline. However, some features require an internet connection, including weather updates, map downloads, and optional account synchronization. We do not guarantee the availability or functionality of internet-dependent features during emergencies.
7. Disclaimer of Warranties
NomadCore is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Lost Pines Creative LLC makes no warranty that:
- The app will meet your specific requirements or be suitable for your particular situation
- The survival information, medical guidance, or emergency procedures are accurate, complete, or appropriate for your circumstances
- The app is a substitute for professional emergency services, emergency training, or medical advice
Always call 911 or your local emergency services in life-threatening emergencies. NomadCore is a planning and reference tool, not a replacement for professional emergency response.
8. Limitation of Liability
To the maximum extent permitted by law, Lost Pines Creative LLC shall not be liable for any damages arising from your use of NomadCore, including but not limited to:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, or use
- Personal injury or property damage
- Actions taken or not taken based on information provided by the app
To the maximum extent permitted by applicable law, Lost Pines Creative LLC's total aggregate liability for all claims relating to NomadCore will not exceed the greater of (a) US $10 or (b) the amount you paid us, if any, for the app. This allocation of risk is an essential basis of this agreement.
Nothing in this EULA limits or excludes any liability that cannot be limited or excluded under applicable law (for example, liability for gross negligence, willful misconduct, or, where applicable, personal injury caused by our negligence). Some jurisdictions do not allow certain limitations or exclusions, so parts of this section may not apply to you; in that case liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless Lost Pines Creative LLC, its officers, directors, employees, and agents from and against third-party claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of your misuse of NomadCore, your violation of this EULA or of law, or information you enter, upload, or share (including another person's information you were not authorized to provide). This does not apply to the extent a claim is caused by our own gross negligence or willful misconduct.
10. Termination
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this EULA. Upon termination, you must cease all use of NomadCore and delete all copies from your devices. The sections on Disclaimer of Warranties, Limitation of Liability, Intellectual Property, and Indemnification shall survive termination.
11. Apple App Store Additional Terms
If you download NomadCore from the Apple App Store, you acknowledge that:
- This EULA is between you and Lost Pines Creative LLC, not Apple
- Apple has no obligation to furnish maintenance or support services
- Apple is not responsible for any product warranties, whether express or implied by law
- Apple is not responsible for addressing any claims relating to the app or your possession or use of the app
- Apple and its subsidiaries are third-party beneficiaries of this EULA and have the right to enforce it
12. Google Play Additional Terms
If you download NomadCore from Google Play, you must comply with the Google Play Terms of Service. Google is not responsible for the app or its content.
13. Updates and Changes
Lost Pines Creative LLC may update NomadCore and this EULA from time to time. Continued use of the app after changes constitutes acceptance of the updated terms. We may require you to accept an updated EULA to continue using the app.
14. Governing Law
This EULA is governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions. Disputes arising under this EULA are resolved as set out in the NomadCore Terms of Service, which require informal resolution followed by binding individual arbitration, with a class-action waiver and a 30-day opt-out. For any matter not subject to arbitration (such as enforcing an award, injunctive relief, or a qualifying small-claims matter), the exclusive venue is the state and federal courts located in Travis County, Texas.
15. Severability
If any provision of this EULA is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remainder of this EULA remains in full force and effect.
16. Entire Agreement
This EULA, together with the NomadCore Privacy Policy and Terms of Service, constitutes the complete agreement between you and Lost Pines Creative LLC regarding the use of NomadCore and supersedes all prior or contemporaneous understandings and agreements. If these documents conflict, the Terms of Service control on use and disputes, this EULA controls on the scope of your software license, and the Privacy Policy controls on data practices.
