IMPORTANT: NomadCore is a preparedness and reference tool, provided "as-is." It is not an emergency-response service and does not contact 911, police, fire, EMS, or any agency for you. Always prioritize professional help and official emergency services. In life-threatening emergencies, call 911 or your local emergency services immediately.
These Terms of Service ("Terms") are an agreement between you and Lost Pines Creative LLC, a Texas limited liability company doing business as NomadCore ("NomadCore," "we," "us," or "our"), governing your use of the NomadCore mobile application and related services (the "App").
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you create an account, you will also be asked to affirmatively agree to these Terms and our Privacy Policy at that time. If you do not agree, do not use the App.
Your use of the App is also governed by our End User License Agreement (EULA) and our Privacy Policy, which are incorporated into these Terms by reference. If there is a conflict, these Terms control on matters of use and disputes, and the EULA controls on the scope of your software license (see Section 16).
2. What NomadCore Is — and Is Not
NomadCore helps you prepare for and reference information during emergencies. It is important that you understand its limits. NomadCore:
- Is not an emergency-response, dispatch, monitoring, rescue, or alerting service, and does not contact 911, police, fire, EMS, search-and-rescue, poison control, or any government agency on your behalf;
- Does not guarantee that any alert, notification, or shared location will be delivered or received;
- Must not be relied on as your sole source of emergency information;
- May contain information that is outdated or incomplete, because laws, official guidance, hazards, weather, infrastructure, and medical practices change;
- May be unavailable or lose data because of battery failure, device damage, software problems, loss of connectivity, storage failure, operating-system restrictions, or service interruptions;
- Cannot account for your specific health, age, ability, training, equipment, location, weather, or circumstances, and does not replace professional training, official instructions, evacuation orders, product directions, or your own judgment.
3. Assumption of Risk
Survival, first-aid, and preparedness activities are inherently dangerous. Information that is appropriate in one situation may be harmful in another. By using the App, you acknowledge and accept the risks involved in activities you may undertake, which can include first aid and medical procedures; fire, fuel, generators, batteries, and electrical equipment; water collection or purification; food storage and consumption; shelter construction; tools; navigation and wilderness activity; evacuation and transportation; severe weather and environmental exposure; and interacting with strangers or third-party organizations.
You remain solely responsible for evaluating conditions, obtaining appropriate training, following official instructions, and deciding whether you are capable of performing any activity. Always prioritize calling 911 or local emergency services, and seek professional help whenever it is available.
4. No Warranty
The App is provided "as-is" and "as-available," without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that information in the App is accurate, complete, current, or suitable for your situation, or that the App will be error-free, uninterrupted, or that defects will be corrected.
5. Limitation of Liability
In these Terms, the "NomadCore Parties" means Lost Pines Creative LLC (d/b/a NomadCore) and its members, managers, officers, employees, contractors, content providers, and licensors.
To the maximum extent permitted by applicable law, the NomadCore Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of (or inability to use) the App, any information in the App, or any action taken or not taken based on the App.
To the maximum extent permitted by applicable law, the total aggregate liability of the NomadCore Parties for all claims relating to the App will not exceed the greater of (a) US $10 or (b) the amount you paid us, if any, for the App in the twelve months before the claim arose. This allocation of risk is an essential basis of the agreement between you and us.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law (for example, liability for gross negligence, willful misconduct, or, where applicable, personal injury caused by our negligence). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
6. Medical Disclaimer
The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified health providers with any questions regarding a medical condition. In a medical emergency, call 911 immediately.
7. Acceptable Use
You agree to use the App lawfully and responsibly, to verify important information from multiple sources, not to rely solely on the App in an emergency, and to keep the App reasonably up to date. You agree not to:
- Use the App for any unlawful, fraudulent, harmful, or deceptive purpose;
- Attempt to gain unauthorized access to, disrupt, or test the security of the App or our systems, or introduce malware;
- Scrape, bulk-extract, or use automated means to access the App, or circumvent access controls;
- Impersonate any person, or harass, stalk, surveil, threaten, or expose another person;
- Misuse another person's emergency or contact information;
- Resell, sublicense, or commercially exploit the App; or
- Copy, modify, reverse engineer, decompile, or disassemble the App, except to the extent applicable law expressly permits.
8. Accounts, Cloud Backup & Sync
NomadCore works fully without an account. An account is optional and unlocks cloud backup and family sharing. If you create one:
- You are responsible for providing accurate registration information, for keeping your credentials secure, and for activity under your account, and you agree to notify us promptly of any suspected compromise;
- Cloud backup and sync depend on connectivity and third-party infrastructure. We do not guarantee that a backup or sync will succeed, and you are responsible for keeping your own independent copies of important data;
- We may suspend or terminate an account for security threats, fraud, abuse, legal requirements, or prolonged inactivity;
- You may delete your account and its cloud data at any time in the App settings or at nomad-core.com/delete-account. Deleting your account removes your cloud data and personal cloud backup. However, information you previously shared with a family group may already exist on other members' devices or in their copies, and deleting your account does not remove those copies. Data retention and deletion are described in our Privacy Policy.
9. Family Sharing & Shared Data
Family sharing is opt-in. If you create or join a family group, you and other members can share information such as inventories, plans, locations, bulletin posts, and contacts you choose to share.
- Shared data is encrypted on your device before it is uploaded. So your family can recover data on a new device, your group's encryption key is backed up to our servers in encrypted form. This means family sharing is not end-to-end or zero-knowledge encryption — we don't read your shared data and nothing in the App is built to, but we do not claim it is technically impossible for us to. (This is different from your documents and your personal cloud backup, whose keys stay on your device or derive from your password.)
- A group administrator can invite and remove members and manage the group. Depending on what is shared, members and administrators may be able to view, change, export, or delete shared content.
- When you share information with a group, other members may keep copies. Once information has been shared or exported, we cannot control what recipients do with it, and removing it or leaving the group may not delete copies others already have.
- You are responsible for what you choose to share and for the accuracy of information you share.
10. Information About Other People
Emergency plans often contain other people's information — names, phone numbers, addresses, medical details, meeting locations, photos, and emergency contacts. If you enter, upload, or share another person's information, you represent that you have the right or appropriate authorization to do so, including for any child or dependent whose information you provide. You agree not to use NomadCore to track, surveil, threaten, impersonate, or expose another person.
11. Content and Intellectual Property
The App, including its software, design, interface, and original content, is owned by Lost Pines Creative LLC and protected by law, and is licensed to you under the EULA, not sold. Public-domain materials (such as certain government field manuals) remain in the public domain. Content you create or enter remains yours; you grant us only the limited rights needed to operate features you use (for example, to store, encrypt, sync, and back up content you choose to save to the cloud or share with a group). We do not claim ownership of your content and do not use it to build advertising profiles. If you believe content in the App infringes your rights, contact us at support@nomad-core.com.
12. Age Requirement
You must be at least 13 years old to use NomadCore. If you are under 18, you must have a parent or legal guardian's consent to use the App. Parents and guardians are responsible for supervising a minor's use, and by allowing a minor to use the App you agree to these Terms on their behalf and take responsibility for their use.
13. Dispute Resolution; Arbitration; Class Waiver
Informal resolution first. Before starting a formal proceeding, you agree to contact us at support@nomad-core.com and give us 30 days to try to resolve the dispute informally.
Binding arbitration. If we can't resolve it informally, any claim, dispute, or controversy arising out of or relating to these Terms or your use of NomadCore will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitration will be seated in Travis County, Texas, and Texas law applies, but the arbitrator may allow you to participate by phone, video, or written submissions, and you will not be required to travel unreasonably. Judgment on the award may be entered in any court with jurisdiction.
Class-action waiver. Arbitration and any proceeding will be conducted only on an individual basis, not as a class, consolidated, or representative action, and you waive any right to participate in a class action or class-wide arbitration.
Exceptions. Either party may (a) bring an individual claim in small-claims court if it qualifies, or (b) seek injunctive or other equitable relief in court to protect intellectual-property or security interests.
30-day opt-out. You may opt out of this arbitration and class-waiver section by emailing support@nomad-core.com within 30 days of first accepting these Terms; opting out does not affect the rest of these Terms.
This Section 13 governs dispute resolution and controls over any conflicting provision in the EULA. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will proceed in court under Section 14.
14. Governing Law & Courts
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. For any matter not subject to arbitration under Section 13 — including enforcing an arbitration award, seeking injunctive relief, or a qualifying small-claims matter — the exclusive venue is the state and federal courts located in Travis County, Texas, and you consent to their jurisdiction.
15. Changes to These Terms
We may update these Terms. We will update the "Last Updated" date above and, for material changes, take reasonable steps to notify you (for example, in the App or by email) before they take effect, and where legally required we will ask for your acceptance. If you don't agree to a change, stop using the App before it takes effect. Disputes that arose before a change remain governed by the version of these Terms in effect when they arose.
16. General
- Entire agreement & precedence. These Terms, together with the EULA and Privacy Policy, are the entire agreement between you and us about the App. If they conflict: these Terms control on use and disputes; the EULA controls on the scope of your software license; the Privacy Policy controls on data practices.
- Severability. If any provision is unenforceable, it will be limited or removed to the minimum extent necessary and the rest stays in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Survival. Sections on assumption of risk, warranties, liability, intellectual property, dispute resolution, and indemnification (in the EULA) survive termination.
- App stores. Additional Apple App Store and Google Play terms in the EULA apply to downloads from those stores.
